Understanding The Common Types Of Personal Injury Cases

Blog

If you have been involved in an accident then you could be entitled to compensation for your injury, lost wages, or other grief caused by the incident. Knowing exactly what types of personal injury cases are taken to court can help you decide if you should seek out legal representation. Here is a simple list of some of the most common personal injury cases.

Slip And Fall

This particular type of personal injury happens when injuries occur related to a person slipping or falling. In order to win a slip and fall case one must prove that the property owner could have prevented you slipping or falling. For instance, if you fall because of excess water on the ground due to a spill that was caused by the property owner then you could be eligible. If the owner knew there was hazardous conditions but did nothing to prevent an accident from happening, then they may be legally responsible to pay for the damages.

Wrongful Death

Wrongful death cases happen when a person dies due to another person's negligent or intentional act. These cases are typically filed by the family of the deceased and they are forced with providing proof that the defendant was responsible for the negligent act that caused death.

In the case of wrongful death, the person found liable is typically forced to pay monetary damages in the amount that the deceased would have made over their lifetime. The family of the deceased could also be awarded an amount for pain and suffering to make up for things like lost companionship, intimacy, moral support and love.

Car Accidents

This type of personal injury case is filed by those involved in a car accident for pain and suffering, as well as disabilities that were incurred because of the accident. The plaintiff will be seeking monetary damages to cover any medical expenses, pain and suffering, lost wages, and emotional grief that were a direct result of the accident. These cases are typically built around accidents caused by drinking and driving, driving without valid insurance, or reckless driving offences.

If any of the cases outlined above describe your situation then you should immediately contact a personal injury attorney (such as one from Burke Schultz Harman & Jenkinson Attorneys at Law) in your area and set up a consultation. The personal injury attorney will be able to sit down with you one on one and go over your situation and work to build a case for you to be compensated for your injuries.

My Day in Court

When I sued a product manufacturer after a disfiguring accident, I never expected to actually go to court. I assumed that the case would eventually be settled, like most personal injury cases are. To my surprise, they wouldn't budge, and we ended up having to go all the way to court. I was pretty nervous about testifying, but I had a great attorney that prepared me well, and everything went smoothly. In the end, the jury saw things my way. I realized that I probably wasn't the only person to ever experience an unexpected day in court, and that's how I got the idea to start this blog. If you're looking for tips to help you prepare or wondering what to expect when you go to court for a lawsuit, this blog contains important information for you.
